Anita has put her finger on a key point:

• Such certification of prior learning is effective and can be
successful only if the country's legal structure makes it mandatory or
links it with certain incentives.

The key is the Legal Structure.  Laws that are enforced are obeyed.
Incentives can include punishments for non-compliance.

Helga has identified another significant concern:

• The focuses of TVET however, remained on production and spend little
attention to all of the side problems caused by it.

The Side Problems include Occupational Health and Safety, and Environment
(OHS&E), which include Harm to Workers and harm to the Public.

Laws that enforce compliance with OHS&E concerns require employers to
ensure that workers are competent.  The consequences for non-compliance
here are up to a $300,000 fine, plus up to two years in jail, per
incident.

The creation and enforcement of laws is outside the domain of TVET.
Training and Educating individuals to be compliant with applicable laws is
within the domain of TVET.

The content of TVET courses and programs reflects the applicable legal
requirements for Worker Certifications and OHS&E Compliance.

• On the night of December 3, 1984 in the Union Carbide plant at Bhopal,
40 tones of methyl isocyanate (MIC) gas leaked without any warning. The
poisonous gas leakage killed 3,828 people immediately, injuring hundreds of
thousands, incapacitating most of them for life. In addition, thousands of
cattle, nearly poisoning water, polluting surrounding air for miles
affected the breathing capacity of the people, and other long lasting
disastrous effects (Gupta Forthcoming). According to Amnesty International
(2004, 1) 22,000 people have died of their injuries.
• …The Government of India and the Union Carbide reached an out of
court settlement for $490 million. Compensation claims of 1,029,517 people
were registered, out of which 574,304 claims were awarded (Bhopal Gas
Tragedy Relief and Rehabilitation Department 2009). However, only a small
portion of the compensation has been distributed to the victims due to
legal and administrative procedures.

How have the laws in India changed in response to this incident, with
regards to OHS&E and Certifications?  How has TVET in India adapted to
these legal changes?

I suggest that TVET Administrators pay attention to the Acts and
Regulations being proclaimed by Legislators, in order to develop relevant
TVET Programs that will enhance the employability of graduates.
